To import or manufacture a hazardous substance for release, an application needs to be sent to ERMA New Zealand. This is for all applications for the release of a new hazardous substance that does NOT meet either of the criteria for rapid assessment. The majority of applications are expected to be of this type.
Because the substances will cover a wide range, eg from a speciality industry chemical at one extreme, to a new agricultural pesticide at the other extreme, information requirements will vary widely. This process includes a public consultation process. The purpose of the import or manufacture is publicly 'notified' through an alert in the major daily newspapers, on our website, in the Bulletin, and by notifying people who have indicated to us that they wish to be advised of particular types of applications. There is a 30 working day period for submissions. A public hearing will be held if any party wishes to be heard, or if the decision-making committee thinks it is necessary.
Consultation of the applicant with Māori is likely to be needed in situations where risks of significance to Māori have been identified. Another difference with this process, compared with the 'rapid assessment' process, is that costs and benefits of the import or manufacture are taken into account in the decision-making process.
Therefore, some level of risk (and cost) may be acceptable as long as the benefits outweigh the risks (and costs). These matters must be addressed in the application.
